Conveyancing

The process of transferring the title of a property from one person/entity to another

Overview

Conveyancer near me

Conveyancing (conveyance of property) is usually done by either a licensed conveyancer or a solicitor, whereby a professional fee is charged (conveyancing fees). Our firm always provides transparent upfront pricing arrangement so that you are aware of the costs without any surprises. While conveyancers are well-versed in managing the legal aspects of transferring title of a property, a conveyancer scope of advice is only limited to the transfer of the property and does not extend to legal or accounting advice. We have offices based in South Australia and New South Wales and we also offer to meet over a Teams conference (where required).

At J&A, we believe in flexibility and understand the needs of our clients.

Conveyance of property (the process)

Amongst other things, the conveyancing process generally involves:

  • Preparing, perusing, negotiating and exchanging a contract of sale.
  • Assisting you with proposing the required special conditions to the contract.
  • Reviewing and managing key transaction dates.
  • Reviewing the statutory government searches and researching the property for any outstanding issues such as arrears, easements or illegal building work.
  • Liaising with your financer (whether incoming or outgoing) and ensuring your mortgagee is on track for a smooth settlement.
  • Calculating rates and taxes adjustments and providing you with a settlement statement (which breaks down all money coming in and going out).
  • Stamping the Memorandum of Transfer and paying stamp duty on your behalf.
  • Attending settlement and certifying/lodging the Transfer.
